"NEW ORLEANS - Hurricane Katrina victims whose homes and businesses were destroyed when floodwaters breached levees in the 2005 storm cannot recover money from their insurance companies for the damages, a federal appeals court ruled Thursday."
just backs up what I think about insurance companies .. happy to take your money, but will find some way to interpret some oddly worded paragraph and avoid providing you with relief
I saw one guy on TV .. said the insurance company wouldn't pay damages because ALL of his damage was caused by water (storm surge) .. then he pointed up in a tree at a piece of sheet metal that had been whipped right through a 12 inch diameter tree limb .. then he said .. apparently, water did that
Not only that, but insurance companies are now not issuing/renewing policies all along the Gulf Coast - TX, LA, MI, AL, FL. Or making it very expensive if they do. Even several miles inland and above actual flood level!
That would make it tough to buy/sell a house since lenders rightly won't lend if there's no hazard / flood insurance to protect them!
BTW, after Katrina, much of Mississippi's coast looked like the Asian tsunami for a couple miles inland in many places; even Mobile, AL (at upper end of Mobile Bay, about 30 miles from the 'ocean') had 6+ feet of water downtown from storm surge!
I really, really ... really ... really hope that some well recognized law firm or individual, challenges this decision.
There is definite change needed ... very much so ... to make insurance policies and whichever relevant clauses ... much more transparent for the consumers.
A quote from an episode of All In the Family...
After a fire in Archie's bathroom...Archie gets an unfavorable settlement from the insurance company...
Archie: What ever happened to the people that told you... you were "In Good Hands"?
Insurance Adjuster: Well, every now and then...all you ever get...is a finger!

Actually, I would hope what ends up happening is that not only is that judgement challenged (because insurance companies seem to forget OVER AND OVER again, that they're not just there to take money, but that the whole point of having insurance is so that after collecting all our money they have to redistribute some of it back out when it's needed), is that someone sues the govt - city, state, whoever - for not maintaining the levees properly.
There were people who pointed out the problems 2-3 years in advance and I believe (but I could be wrong) some of them were gov't officials calling for funds. Again... I pay my taxes to have my roads maintained, to fund publics schools, have public libraries i.e. for the benefit of my community as a whole. Not for pork barrel spending and lining politician's pockets.
