Hi all...

Googling my name, I came across this Rips on Webshots/thendunstinsaid ..I not only found mine, but a whole lot more from members of Caedes on this 'guys' pages! ...
I already am a member on here, and mailed this person to remove mine!....awaiting a reply!...

Sites like that are full of rips mate. I think your plea to the person about your image will probably fall on deaf ears. To get rid of your image you will have to file a DMCA notice. Hassel you could do without but I think you got to do it mate.

Just an FYI.. webshots seems to be owned/operated by american Greetings, a large greeting card company (think "Hallmark"). Perhaps some contact with them might be usefull.

webshots are pretty lame at removing things even with a formal notice - in the past, the easiest way I have found is to sign up so you can use the report abuse function - that seems to be the only route to quickly action anything.

If anyone has a myspace profile page set up and running, in addition to following Phil's suggestion above ... a personal message to Tom via myspace's internal messaging system might indeed reach him sooner. There isn't a lot of activity on or in his webshot online albums.

Good thing I own a mac pro, can't get viruses, why doesn't everyone switch to a mac? I mean pc's known for the famous so called Viruses. I mean if people were smart they switch right? Well I'll leave that one up to you guys.

OK finally thendustinsaid took my work off his webshot account but still a lot remaining that should be taken off unless the owner said that he could. I got a long message on my myspace from the reply, I don't think I was being rude to him but an of course he thought I was being rude.
He may have a point but the fact that he didn't ask the owners if he could post it is still wrong and also unlawfully wrong.

This is what he wrote if anyone cares to take 5-6minutes to read.

I go to Caedes frequently and download images I feel would make good background images for my screen saver. I have about 1000 of them on my old desktop and had no way to transfer them to my new laptop computer because I'm without a home network or a DVD/CD burner on that PC. I also needed to transfer a bunch of other files. Rather then go through Caedes and find the images again, I looked online for ways to transfer a large amount of files from one computer to another. I wasn't about to buy a portable hard drive (it probably wouldn't have worked with my old system anyways), transfer them one file a time via a floppy disk, or e-mail 3 or 4 files at a time via gmail. Most online storage/transfer sites seemed like a good idea until after you tried to upload and realized it was a total scam. Webshots seemed the easiest way to upload the photos and then be able to download them from my other computer. I used the service to store and transfer my screen saver images, I never passed these photos off as my own, I decided to leave them up in the event of a system crash.

Personally, I think you handled this poorly and immaturely.

First, you should be happy people think your images are nice. After this sour taste in my mouth, and trust me, I won't ever been looking at, or sharing your images with my friends anymore. I think it's a shame when artists aren't stoked that people like their images. It's not like you are selling them either, you've already posted them elsewhere, free for all to download, admire and share, on Caedes.

Second, you had my contact info and could have just contacted me about the "situation", if you were really concerned. What you were concerned about, I'm not too sure. The file name was the same as it was on Caedes, I never claimed ownership or that I took the photos. I simple placed them under an "Awesome Images" folder and said they were awesome images for backgrounds and screen savers. I wasn't selling them and you placed them online for free so you weren't selling them either. Also, no one goes on my account, it's not like I'm marketing or advertising it, my girlfriend probably browsed them once, but thats about it. It gets zero traffic, I only use it to store photos. I don't see what damages you could claim for the alleged infringement other then equitable, and they are already down, so you really have no legal recourse. So it's silly for you to be throwing around legal terms. Again, you could have just contacted me yet you choose to be very immature and hasty about it. I practically forgot all about my Webshots account, but your pictures are off it, don't worry, no one I know will ever see your photos ever again.

Seriously man, be a little nicer in your dealings with people in the future. You've just lots a big fan and I won't ever enjoy your work again.

Andy.. maybe you could write back to him and explain that Webshots are full of ripped images and have been known to sell ripped images and that we were protecting the artists who have put hours and hours of work into their images.

Unless there is a server lag, and I don't think so ... I am still seeing the online album of Dustin by clicking on the link in Bob's first post that still contain images of caedes.net members. So ... here is the letter sent to Dunstin via webshots internal messaging:

"Hey Dustin,

I am a member of caedes.net and have become aware of your placing images/photos from members of caedes.net in your online albums on webshots.

Although you make think your actions are innocuous and simply something similar to placing files on an FTP site ... rest assured, you are infringing on copyrighted material by redistributing the images on webshots.

And I quote from caedes.net's copyright policy that is placed on each and every image/photo with a link to this information:

"Things you CAN'T do with the image without specific written permission from the author:

Upload the image to any other website for redistribution.
Remove any watermarks (hidden or otherwise) or information placed by the author to denote ownership.
Use the image as any part of a webpage (e.g. you can't use the image as a webpage background).
Use the image as any part of a commercial endeavour (e.g. you can't use it on a CD label).
Use the image as part of any public endevour (e.g. you can't use it on a brochure for a non-profit organization).

That really is the crux of the complaints you have received from members of caedes.net.

That aside for a moment ... you responded to andy721 stating that 'you weren't selling anything'.

Wellll ... there is a possibility that the works of the members of caedes.net could, in fact, be sold derivatively through webshots.com store of products. Prints, cards, housewares ... and more!!

Look to the upper right of the web page ... see that word 'buy'?

I am asking politely that you remove them. The naming convention is as follows ... artistname-1234567890.

Again, artistname ... hyphen ... followed by a ten digit number.

Had you asked for permission first, there is a good chance that some of the artists might have agreed to the additional publicity of sorts. However, I can't speak for them.

If you do not remove them ... the members of caedes.net or authorized agents for, will avail themselve of the "Flag this page for inappropriate content" option.

Yes, it will take some time and yes, it's a pain in the butt. I sincerely hope that that step can be avoided.

It might be prudent to check the link once more in a couple of days. If the images are still up ... use the "Flag this page for inappropriate content" option located in the bottom right portion of the webpages.

Andy was rude because he didn't contact me first. I had no idea posting them on Webshots was wrong. I had no idea webshots sells "ripped" images. But it doesn't look like they are making much of a profit on it, and you guys are giving them away for free anyways! I thought I was using the service to store photos on my personal web page in the event of a hard drive crash, so that I wouldn't have to find all my favorite images again. I was never claiming ownership, I didn't change the file names or alter the photos. Rest assured people, I will never look at your images again, all of you people that send me messages (on myspace and on webshots) are totally rudes and need a lesson in the law. I wasn't redistributing the images, ok. Look at my page views, I wasn't getting any. Get off my back. Andy has sent me three harassing messages and he is also harassing my girlfriend on Myspace. You people are ridiculous. Please just delete this Topic thread, I've had enough of this site, you guys have made me feel so negatively about this site, something that I once visited daily because I thought it had such great art. As a further f.y.i. Dustin, and once again I quote from the copyright section;

"All images found at caedes.net are protected under copyright law unless the description specifically states otherwise. In the image preview area of caedes.net, each image is accompanied by an "Author" field. This author retains full ownership over the image and has the right to pursue litigation against persons for unauthorized use of said image.

Things you can do with the image that don't require permission from the author:

There is no problem with using the images/photos from caedes.net for personal use ... only.

I didn't break any copyright policy of this site. Why don't you really read every word of it, you'll see. I did upload the pictures I liked from this website to my personal webshots site for storage and for personal use. I never intended to upload for redistribution, nor did that ever occur. I use my common sense. My webshots site is for me and my close friends to enjoy only. I don't know how you came across it but please do not go on it again. Your persistent harassment has gone on long enough. Just stop, please. I can't believe Caedes would sponsor such behavior!!!
