I recently posted two photos of Elvis. I was notified that those photos were rejected. There was a concert of Elvis' on TV and I took some photos of that, then I used my Photoshop and PSP to do a bit of special effects on the photos I took. I am unclear why those were rejected. I have read the "rules" about photos. This was a public concert, no copyrights were infringed upon. If someone could please explain this to me, I would greatly appreciate it. January 8 is his "B-day" and I thought it would be fun to post something of his that is a public concert on TV. Thanx. Verena
Please, even if you don't visit my gallery, check out my "Faves".I've left them intact since day "1", and would like it if every image there got the attention they deserved.
There are other issues to take into consideration also. Typically, many situations that the public assumes to be ok to document with any type of recording equipment (audio or visual) are infact often restricted. This includes concerts, museums, official buildings etc.
For instance if you look on the reverse of a concert ticket there will most likely be a copyright statement from the promoter expressly forbidding the use of cameras or recording equipment within the concert. Whilst it is often tolerated for personal use it certainly would not be permitted for retransmission via any electronic medium.
As an example, copyright laws generally have specific clauses for photographing subject matters that are generally assumed to be free to do so… like this little excerpt from the U.S. copyright legislation concerning photography:
‘Works of art - sculptures, paintings, and even toys - are protectable by copyright. Furthermore, buildings created on or after December 1, 1990 are protected by copyright. A copyright owner has the exclusive right to reproduce a copyrighted work, and photographing a copyrighted work is considered a way of reproducing it. Thus, you may need permission to photograph a building or an art work.’
The other consideration is that the site has never encouraged or allowed what is considered to be ‘fan art’ whether that is of celebrities, characters, games etc. again as it is a grey area hovering over copyright rules.
