Hello! I'm sure this has probably been discussed in another thread....but I couldn't seem to locate it. I was wondering if creating images from famous people is permissible on Caedes. Perhaps a famous actress, or model...or maybe even your favorite Nascar driver. Just wondering! =0) Randy

Only if you took the original photo or found it in a stock library/public domain/have permission from the author.
From this site: "Most important to the ... artist is that a derivative work can only include copyrighted material if it is created by the owner of the copyright on the original material, or with that person's permission. This means that making a collage that includes photos from National Geographic, Rand McNally maps, or pictures of Andy Warhol paintings, is illegal unless you have obtained permission from whoever owns the copyright on those works."

I took a photo of "Dubya" a while back and posted it on here to show my feelings towards the organization of politics (politics in general, not him). It was deleted, but not because of a conflict. Should it have been snagged sooner?

No, see, you took that photo. That's fine. You can do anything you want with it, it's your photo, your original, your property. Same thing with drawing. Draw someone famous, it's fine, it's your work. I was merely bringing up the point that, say, downloading a celeb photo from IMDB and pasting it on some background is not acceptable, since the original photo is not your intellectual property.

Let me see if I understand this. If the photo is of someone famous, it's okay to upload as long as I was the person behind the camera?

So lets say I go to the Buick open and snap a shot of Tiger Woods gnawing on a hot dog before his round. Lets further say that I believe that the shot is aesthetically pleasing enough to be uploaded to caedes. If I upload the picture, can Tiger sue me? (Yeah, right. Tigers gonna sue me for my entire net worth of 748 dollars and 12 cents which includes a 1979 Chevy Vega with three doors and half of a windshield.) Nonetheless, the concern is the same. Can legal action be taken against me for distributing a photo of someone (especially someone famous) when the photo was taken in public? I guess if that was the case then paparazzi would be flipping burgers... but I'd like to hear someone reassure me anyway.

BTW, no, i don't have any shots of Tiger Woods pounding down a hot dog (or anyone else for that matter). This was just a hypothetical question.

Actually, I just stumbled across a pdf of the rights you have as a photographer, link here. Not telling you to go stalk Tiger, but as long as you're both in a public place, it's not wrong.

Hematoma: If you take a picture of Tiger eating a hotdog, and the picture is nothing more than a snapshot, then it is doomed (in spite of the fact that the only reason I watch golf is Woods).

Well camerahound has the key second point. It's fully within the law to photograph a famous person in a public place, but if it's not a good wallpaper, it'll fall to the axe on this site anyway.

I understand the snapshot policy. Notice how I said "Lets further say that I believe that the shot is aesthetically pleasing enough to be uploaded to caedes." I dunno, maybe the lighting might be awesome and the framing truly inspired. What if he had a particularly ruminative countenance as he masticated his snack. Okay, I'll stop.

Anyway, Camerhound, don't fall off the bandwagon! =P I suppose there's no need to worry about that just yet, though. Tiger got back to back eagles on his way to an 11 under 61. He's on the prowl!
