I am really impressed with the quality of the artwork that you all are producing and I was wondering if I could use your images as backgrounds for when I make DVD@S for my hobby. Absolutely non commercial use only . If I dont see your reply I will take it as OK.
once again nice work.
rather than just posting a sweeping question you should perhaps send a message to the individual artists of the work you want to use to clear it with them directly. thanks.
Phil's right, there's a lot of artists who don't come & look at the message boards, so if you assume a non reply is a tacit consent you could be very wrong. You really need to contact the artist(s) in question first.
Beyond being very wrong, you would actually be in copyright violation. As all the images are the individual property of each artist, each artist must be contacted for their consent. You cannot assume permission has been granted due to lack of response.
Failure to obtain permission will result in the PIIN being released. 8•P
Just going to let myself into your studio and borrow a few things for personal use. That Sony PD 170 will definitely come in handy, since I busted my Sennheiser MKH60. If you don't get back to me ... or the police ... I'll know that it was cool with you.
Thanx. :o)
p.s. I borrowed your car too to get to my gig. Left a note. Danke".
Do the semantics sound familiar?
PM, or private message those whos' works you wish to use. If you can take the time to find their images, you can take the time, then and there ... to make that contact.
If I am sounding harsh or too terse in my words, I will gladly apologize.
I don't think that Clive is that naive to copyright infringement. And having found out that Clive participates at a more than hobbyist level in my opinion in this kind of work, tells me he should be more knowledgeable ... and that there is no short and easy workaround.
This particular 'beaker of water' has been tainted by those that precede him, many times over. So, yes ... I am a bit jaded.
The discussion is open ... he can return to clarify, if he so chooses.
I agree, it doesn't take that much effort to personally ASK permission. Not doing so is not only rude but also ripping. Clive, don't use any of my stuff unless you ask permission first, and receive it. Sorry if my response bothers you. Copyright infringement bothers me..; P
....lol, i dont mind (i actually like reading the posts). But, er, 4 responses is a little bit of an overkill...but i guess it does get the point across better, so i guess you guys are right.
PS: Does he even have to ask if he will only use it for personal use? I never really read over the copyright thing, i'll do that right now...which i shouldof done b4 i wrote this.
Noah, he said he would assume it was ok to use our images unless he heard from us. That's why I replied, it's not ok the way he's going about it. Why do you always think you have to interject and have the last word, especially to rag on the people that are only doing what they were asked...to respond.
noah, four different responses from four different people is to be expected, if anything. and, in the context Les used, would you like it if we walked into your house and took or 'borrowed' something without asking, under the assumption that 'it should be ok'?!?
and honestly, Larry has a point (no not the ones on his head :P) a little silliness here and there is fine...we all need a laugh at times... but really, just randomly typiong some God-awful nonsense has the same feel as a little kid butting in with what he thinks is a cute comment... in the middle of an adult conversation. you're a good kid, noah.. but a little restraint would be greatly appreciated :o)
But, if he is using it for personal use, i didnt find sumthing that said he must request permission. It's kindof like saying: 'i'm going to use your image as a wallpaper. If i dont see a reply, i'll assume it's fine." Replace the word "image" with "movie" and we got what we have right here.
The only problem with his request was, "If I dont see your reply I will take it as OK." But, umm..yeah i guess that isnt ok to say, but, not every1 is flawless. I'm assuming it was a mistake, or...well, something not to worry about for the time being.
But like you said, i'm a teenager, and i still have a lot to learn. Just saying what i think.
The fact is Noah... if you bother to click on Vigilante in the discussion board (something different to offtopics for a change) you will see how many times our images have been "borrowed" without permission... even some have "borrowed" them to sell.. so NO you can't just drop a line here expecting its ok YOU MUST ASK EACH ARTIST.. So please do not use mine unless you ask me first, cos I will find out and send the chihauahua's out....
and I guess that makes me number 7...
and another thing Noah.. even if you are using it for personal use eg. background on your myspace page... you still have to ask permission unless you are using it as wallpaper for your desktop then you dont...
ok, first, i think you missed what we're getting at. if this was aperson totally new to art and working online...sure..maybe a mistake. doesn't seem to be the case here. and just because someone isnt present to actually say 'no' it doesn't imply 'yes' by default.
second thing.. no slapping of the head... and yes you're a teen...like we all were (long loooonng ago...) and yes you have alot to learn. and no, your opinion doesnt count any less. (despite the amount of cringing some of us might do when you express it ..hehe) just... maybe..take it down a notch...or three.. deal?
Ok. Noah... 1st he isnt using it as wallpaper on the computer "images as backgrounds for when I make DVD@S" for his hobby...
and 2nd hobbies can make money.. I dont want that risk thanks.. especially when I am trying to sell my own work which was made from MY creativity, and MY hours of work...
I'm not going to argue because these are the facts and I'm sure most people on here would be thinking the same way.....
Wow ... didn't think of that ! Actually, what I DID of was to wonder if some attorney had suggessted that he make this post in the hopes of holding off any screaming artists with a " Well I said in my post & you didn't say no, so ... "
btw Clive .... Jackie might have the chihauahuas , but I've got a 65 pound Standard Poodle & a cranky Chow mix.
Hi everyone,
| appreciate the comments made and will contact the individual artists. As I also said I do make dvds for a hobby and for non commercial. If I was a dishonorable person not respecting the individual artists rights would I have even bothered asking at all as you would never know whether I have used your work. Food for thought. Keep up the good work.
Seriously though, this could have been avoided if you had simply checked the FAQ. It's always a good idea to start there before you start posting on the discussion board. Not being critical, just offering advice for future reference.
once again nice work.
Clive
