Photography competition terms

I was looking at entering a competition held at a library near where i live, but after looking through the terms and conditions it might not be such a great idea

* For a period of ten years from the date of submission the entrant licenses the State Library of Western Australia to use the entrant’s photograph(s) to promote this competition and for research and other non-commercial purposes.

* Ten years after the date of submission the entrant hereby transfers ownership of copyright in his/her photograph(s) to the State Library of Western Australia for the balance of the copyright term. The entrant will have a non exclusive license to use their photograph(s) in any way they wish.

Would anyone here be able to help? especially with the meaning of a non exclusive license?

if anyones interested the competition page is here.

Thank you

*I'm NO lawyer

Granting YOU a non-exclusive license to use your own photo for anything you wish .. SHOULD include

1) .. YOU selling it in print form
2) .. YOU selling it in electronic form
3) .. YOU publishing a book containing it

etc ..

(Non Exclusive means that THEY would also be able to USE the photo in print and electronic form)

the odd thing is that second * .. transferring ownership to the library "for the balance of the copyright term" .. copyright term is, what?, 50 years after the death of the artist? .. they don't even say you will be credited as photographer .. although, if you WON the contest .. they would have the rights to use your name as well .. as though YOU are endorsing and promoting them as stand up citizens and business persons

if all they (the library) wants to do is use the image on posters, print ads, possibly TV ads .. to promote FUTURE contests .. they can accomplish that via a clause aimed at that .. NOT by taking legal ownership .. I would think

the benefits of winning .. or, even just entering, would have to be VERY VERY GOOD

.. just my $0.02

I go in competitions regularly, most competitions don’t have conditions like that. I would look elsewhere if I were you.

There are three colours, Ten digits and seven notes, its what we do with them that’s important. Ruth Ross

Thanks for the advice, $1000 seemed tempting for a student who only earns $9 an hour :-(, anyway i think i might have a look around and see what else is on offer, thanks again

Art is the perception of the creator. Meaning is the perception of the viewer. acceptance is the perception of society.
