Announcing Contest #14: Pop Art Challenge

Submitted by xentrik 06/18/05 2:54 PM GMT

"Everything is beautiful. Pop is everything." -Andy Warhol
The theme of out next contest will be based on the movement of "Pop Art". Loosely, pop art is creating something artistic from an easily recognizable, or perhaps grossly overused, popular cultural icon. Some examples of this movement include Roy Lichtenstein's Mustard on White, or Andy Warhol's Campbell's Tomato Soup, or Mao. The challenge in this contest is to create your own piece of Pop Art. Click the link below for continued rules and deadlines.

Submissions should not be made before Wednesday, June 22nd, to allow time for questions to be posed regarding rules. After that, rules are set, and submissions must adhere to them in order to be considered during voting. Please post any questions in the thread below so all will know the answers. All submissions must be made by Sunday, July 10th at 11:59PM EST.

  • Submissions for the contest must be done in the pop art style, that is, based on a pop phenomenon. More examples of the style can be found on this page, and google has many more examples.
  • If you choose to use photos within your submission, even edited photos, they must be in the public domain (or a stock library) or taken by yourself or a teammate.
  • Optionally, you can work in a team of 2-3 members.
  • One individual and two team submissions per person will be accepted at the end of the contest. If you wish to replace a submission, remove it from the site or ask a mod to move it to the new images gallery.

Ooooh, excellent idea...can't wait to see what the amazingly talented people at Caedes will come up with ^_^
So...can you only upload one image? and it can picture absolutely anything (within reason) as long as it's in a pop art style?
Good luck everyone!

That's correct, one image individually, but if you team up, you can have up to 2 more. So each person can have a hand in 3 submissions, but to do that, two of them must be collaborative.
And yes, anything "popular" that will still remain within the Code of Conduct. =)

Given the example of the soup, where do we stand with copyright on this occasion?

Oh man, how did we miss thinking of that... I started looking into it and copyright law is making me incredibly sleepy. I'll have some ruling on that in the morning.

Good call, if i understand this correctly, its going to be tough to avoid copyright stuff.

There are still images that could be made. For example - Warhol's cow image - nothing there that needed to avoid copyright laws. Mustard on White - nothing there either. This is a good time to be thinking outside of the box.

After conferring with caedes and several (intensely boring) web sites, it seems you should be fine to submit works including trademarks. Trademark law is strict with regard to competing products and companies but should allow for the noncommercial purpose of this contest. I found a nice, long passage from case law that says this, but is summed up much more succinctly by "As long as the picture is not being used in such a way that it would "confuse" a viewer into believing that your site was affiliated with, sponsored by, or otherwise associated with the trademark holder, then there should be no problems" from this page.

I also found that, according to a source quoting the estate of Andy Warhol, he did not originally seek permission from Campbell's Soup for his art. The company apparently did not take offense, and "saw his usage as amusing and the freedom of expression". Licensing agreements did not begin until the estate sought to use the image on commercial products.

So, in sum, you should be fine to incorporate trademarks, so long as they aren't in competition with, or mistaken as a company's endorsement for, you or caedes. In other words, the "Ford" logo should be fine, but stay away from the logo for "Webshots". =D
(PS - We reserve the right to deny images for this reason if we feel that something is really not right. I wouldn't expect it to happen, but I'm letting you know just in case.)

I am not sure I fully understand the subject material requested. Do we just find some comic strip or canned food item and find someway to paste it on a computer?

You have to "create something artistic from an easily recognizable, or perhaps grossly overused, popular cultural icon." Not that it will be easy or anything. =)

edit: Started before caedes' comment:
No; the purpose of pop art is to give some artistic quality to something that is ubiquitous. In Warhol's day, soup was commonly advertised, and Mao was constantly in the news. If he were working these days, he'd possibly have done something involving McDonald's or Brittney Spears. The example grimbug linked actually includes Lichtenstein's work, the comics themselves.
Since you bring up the comics, note that it is okay to use others' trademarks, not copyrights. The difference here.

are we allowed to use photos off the internet and then edit them such as a simple bag of m&ms then edit it to create the pop art

The second bullet in the list states that "If you choose to use photos within your submission, even edited photos, they must be in the public domain (or a stock library) or taken by yourself or a teammate." So if you use photos from the internet, you must have the rights to use them (hence the public domain/stock library stipulation). A good stock library can be found here.
